Terms and Conditions
The general terms and conditions of sale (hereinafter referred to as the “General Terms and Conditions”) set forth below exclusively govern the contractual relationship between any non-professional user of the websitehttps://florencemoorhead.com (hereinafter referred to as “the Buyer” or “You”) and the merchant Florence Moorhead, owned by the company MOORHEAD with a capital of 4,000 euros, whose registered office is located at 83 Avenue Faidherbe, 93100 Montreuil, and registered with the Seine-Saint-Denis Trade and Companies Register under number 91264025700016 (hereinafter referred to as “Florence Le Balc’h”).
These Terms and Conditions are the only ones applicable and supersede all other terms and conditions, unless otherwise expressly agreed in writing in advance. Florence Le Balc’h may occasionally need to modify certain provisions of these Terms and Conditions; therefore, it is necessary to review them before placing each order on the website https://florencemoorhead.com/ (hereinafter referred to as the “Website”).
The Terms and Conditions are available on the website at all times and, where applicable, take precedence over any other version or conflicting document. These changes are effective as of the date they are posted online and do not apply to contracts entered into prior to that date. Each purchase made on the website is governed by the Terms and Conditions in effect on the date the order is placed.
The purpose of these Terms and Conditions is to define the rights and obligations of the parties in connection with the online sale of goods offered by Florence Moorhead to the buyer.
The buyer acknowledges that they have read these Terms and Conditions and agree to them by checking the box provided for this purpose before placing an online order. By checking this box, you agree to comply with these Terms and Conditions as well as the Terms of Use contained herein.
Orders
Customers can place their orders online using the online catalog and the form provided therein.
The ordering process consists of three (3) consecutive steps. Once you have selected your products (size, color, quantity) and confirmed your cart, you must:
Create an account or log in if you already have one;
accept the terms and conditions by checking the box provided for that purpose on your order summary page (titled “Summary”);
Select your payment method. Once you have selected your payment method, you must proceed to pay for your order, which will formally and definitively finalize the sales contract between you and Florence Moorhead.
By placing an order, you agree to the prices and descriptions of the products available for sale. Any dispute regarding this matter will be addressed in the context of a potential exchange and the warranties set forth below.
In certain cases, such as non-payment, an incorrect address, or other issues with the buyer’s account, Florence Moorhead reserves the right to hold the buyer’s order until the issue is resolved.
If a product ordered is unavailable, the buyer will be notified by email.
The order for this product will then be canceled and, if applicable, refunded, while the rest of the order will remain firm and final.

Product Information
The products covered by these terms and conditions are those listed on the website https://florencemoorhead.com and identified as being sold and shipped by Florence Moorhead. They are offered while supplies last.
Florence Moorhead takes great care in posting information about the essential characteristics of the products, including detailed descriptions and photographs illustrating the products.
However, Florence Moorhead shall not be held liable for any errors or omissions in this presentation.
Product photographs are not binding.
Price
Florence Moorhead reserves the right to change its prices at any time but agrees to apply the current rates listed at the time of the order, subject to availability on that date.
Prices are listed in euros. They do not include shipping costs, which are billed separately and displayed before the order is confirmed. Prices include the VAT applicable on the date of the order, and any change in the applicable VAT rate will be automatically reflected in the prices of products in the online store. Payment of the full price must be made at the time of ordering. Under no circumstances may the amounts paid be considered as deposits or down payments.
Payment and Electronic Signature
The price is payable in full, in cash, on the day the buyer places the order.

Florence Moorhead reserves the right to suspend order processing and delivery in the event that a credit card payment is declined by officially accredited organizations or in the event of non-payment. Florence Moorhead specifically reserves the right to refuse to make a delivery or fulfill an order from a buyer who has not paid for a previous order in full or in part, or with whom a payment dispute is currently pending.
The online provision of the buyer’s credit card number and the final confirmation of the order shall constitute proof of the buyer’s consent in accordance with the provisions of the Act of March 13, 2000, and shall be deemed to:
payability of amounts due under the purchase order.
signature and express acceptance of all transactions carried out.
In the event of fraudulent use of a credit card, the buyer is asked to send an email to contact@florencemoorhead.com as soon as such use is detected. The bank’s server is secured using SSL (Secure Sockets Layer) encryption to protect all payment-related data as effectively as possible.
Proof of transaction
The electronic records, stored in Florence Moorhead’s computer systems under reasonable security measures, shall be considered proof of communications, orders, and payments between the parties. Purchase orders and invoices are archived on a reliable and durable medium that can be produced as evidence.
Right of withdrawal with refund
In accordance with applicable law, the buyer has fourteen (14) days from the date of receipt to exercise their right of withdrawal with Florence Moorhead, without having to provide a reason or pay a penalty, provided that the product(s) is (are) returned in its (their) original condition, within fourteen (14) days of notifying the decision to withdraw.
The buyer is reminded that, in accordance with Article L. 221-19 of the Consumer Code:
The day the contract is concluded or the day the product is received is not included in the fourteen (14)-day period mentioned above.
The period begins at the start of the first hour of the first day and ends at the end of the last hour of the last day of the period.
If this period expires on a Saturday, Sunday, or a public holiday or non-working day, it is extended until the next business day.
Warranty
The products sold are covered by a commercial warranty that guarantees their conformity and provides for a refund of the purchase price, replacement, or repair of the goods.
It does not cover defects caused by abnormal or improper use, or resulting from causes unrelated to the inherent qualities of the products.
The foregoing provisions do not preclude the application of the statutory warranty of conformity under Article L. 211-4 of the Consumer Code and the warranty of the item sold under Articles 1641 et seq. of the Civil Code.
Transfer of ownership – transfer of risk
Ownership of the products will transfer to the buyer upon payment of the purchase price by the buyer, regardless of the delivery date of the products.
In accordance with the provisions of Article L216-4 of the Consumer Code, the transfer of risk of loss and damage associated therewith shall not take place until the buyer takes physical possession of the products.
